AI Generated work is now copyrightable!
We’ve been saying it for a while now, and we knew that copyrighting in the US were going to be more clear.
As we mentioned many times in the past, if you add the ‘Human touch’ to your AI work, it can now be copyrighted. As of January 26th 2025 it is now official!

The U.S. Copyright Office’s “Copyright and Artificial Intelligence, with its Copyrightability” report, published in January 2025, delves into the complex relationship between generative AI technologies and copyright law.
Key Highlights:
1. Human Authorship Requirement: The report reaffirms that, under current U.S. law, copyright protection is granted exclusively to works created by human authors. Consequently, outputs generated solely by AI, without meaningful human intervention, do not qualify for copyright protection.
2. Role of Human Contribution: The report emphasizes that for a work involving AI to be eligible for copyright, there must be significant human involvement.
This includes:
* Crafting Prompts: The specificity and creativity involved in designing prompts for AI systems can influence the degree of human authorship.
* Selection and Arrangement: Choosing and organizing AI-generated content in a creative manner can contribute to authorship.
* Post-Generation Editing: Substantial modification or enhancement of AI outputs by a human can render the work copyrightable.
Assistive vs. Autonomous AI: The report distinguishes between AI as an assistive tool and as an autonomous creator. When AI aids a human in the creative process, the resulting work may be eligible for copyright. However, if the AI operates independently, producing content without human direction or contribution, such outputs are not protected under current copyright law.
Policy Considerations: The report acknowledges the evolving nature of AI technology and suggests that existing copyright principles are flexible enough to address new challenges. It encourages ongoing dialogue among stakeholders to ensure that copyright law adapts appropriately to technological advancements.
In summary, the report underscores the necessity of human creativity in works seeking copyright protection and provides guidance on how creators can incorporate AI tools while maintaining eligibility for such
